Statutory Forms of Wills in Thailand
Under the Thai Civil and Commercial Code, a Will must strictly conform to one of the five recognized statutory formats:
- Ordinary Will (Section 1656) – Must be made in writing, dated at the time of execution, and signed by the testator in the simultaneous presence of at least two qualified witnesses who must sign their names attesting to the testator’s signature.
- Holographic Will (Section 1657) – Must be handwritten entirely by the testator’s own hand, including the date and signature.
- Will by Public Document (Section 1658) – Declared before the District Officer (Nai Amphoe) and at least two witnesses.
- Will by Secret Document (Section 1660) – Sealed and produced before the District Officer and witnesses with proper endorsement.
- Oral Will (Section 1663): Permitted only under extraordinary circumstances (e.g., imminent danger of death or epidemic), declared before two witnesses who must report to the District Officer without delay.
