Making a Will and Testament in Phuket

According to The Laws of Thailand, any person may, in contemplation of death, make a declaration of intention by Will concerning dispositions as to his property or other matters which shall take effect according to law after his death. Otherwise, if the last will has not been prepared, the inheritance shall be in accordance with the Law i.e.

There are only six classes of statutory heir, each class is entitled to inherit in the following order:

  • Descendants / Surviving spouse
  • Parents
  • Brothers and Sisters of full blood
  • Brothers and Sisters of half blood
  • Grandfathers and Grandmothers
  • Uncles and Aunts

There are several example types of Will and Testament as follows:

  1. Ordinary Will

According to Thai Commercial and Civil Code Section 1656, A Will may be made in the following form, that is to say, it must be made in writing, dated at the time of the making of the Will and signed by the testator before at least two witnesses present at the same time who shall then and there sign their names certifying the signature of the testator.

Our legal service for making an Ordinary Will shall be as the following:

  • Professional Fee THB 7,500 (exclusive of 7% VAT)
  • Declaration of intention by Last Will and Testament of maximum 4 assets (Additional Charge THB 1,000 per Asset)
  • Draft / Review of the Will and Testament
  • Provide one witness (Two witnesses required according to the Law) (Additional Charge THB 1,000 if 2 witnessed required by us)
  • Provide one original language (English or Thai) (Additional Charge THB 2,500 for English or Thai translation)
  • Meeting one hour for execution

Remark Once the payment has been made and all information has been provided, 3-5 working days will be required for preparation of the draft prior to execution arrangement.

2. Public Document Will 

According to Thai Commercial and Civil Code Section 1658, A Will may be made by a public document, that is to say:

  1. the testator must declare to the officer before at least two other persons as witnesses present at the same time what dispositions he wishes to be included in his Will;
  2. the officer must note down such declaration of the testator and read it to the latter and to the witnesses;
  3. the testator and the witnesses must sign their names after having ascertained that the statement noted down by the officer corresponds with the declaration made by the testator;
  4. the statement noted down by the officer shall be dated and signed by such official who shall certify under his hand and seal that the Will has been made in compliance with the foregoing subsections 1 to 3.

  1. Professional Fee THB 15,000 (exclusive of 7% VAT)
  2. Declaration of intention by Last Will and Testament of maximum 4 assets (Additional Charge THB 1,000 per Asset)
  3. Draft / Review of the Will and Testament
  4. Provide one witness and one translator.
  5. Attend district office for the Will signing arrangement.

3. Confidential Will 

According to Thai Civil and Commercial Code Section 1660, A Will may be made by a confidential document, that is to say:

  • The testator must sign his name on the document;
  • He must close up the document and sign his name across the place of closure;
  • He must produce the closed document before the officer and at least two other persons as witnesses and declare to all of them that it contains his testamentary dispositions; and if the testator has not written with his own hand and the whole text of the document he must state the name and domicile of the writer;
  • After the officer has noted down upon the cover of the document the declaration of the testator and the date of the production and has affixed his seal thereupon, the officer, the testator and the witnesses must sign there names thereon.

Our legal service for making a Confidential Will shall be as the following:

  • Professional Fee THB 15,000 (exclusive of 7% VAT)
  • Declaration of intention by Last Will and Testament of maximum 4 assets (Additional Charge THB 1,000 per Asset)
  • Draft / Review of the Will and Testament
  • Provide two witnesses.
  • Attend district office for the Will closure arrangement.

List of information and document required for making a legitimate Will and Testament are as the following:

  1. Passport and ID No. of the Will owner
  2. List of assets and supporting documents such as Title Deed, Bank Account, Car registration, and etc.
  3. Plan of disposition of assets to the heir(s), name and local ID of the heir(s)
  4. Name of the executor
  5. No. of required copy and name of each Will holder.
  6. Name of witness(es) if provided by will owner. (Witness cannot be a person who receives any asset in the Will)
  7. Other detail as required.
  8. Expected date of signing
