Under Thai Laws, husband and wife are allowed to enter into a prenuptial agreement to establish their intentions regarding asset distribution. Without such an agreement, assets acquired during the marriage will be considered joint property, even if registered in one spouse’s name.

  1. Up to Three categories of assets can be arranged differently in the agreement. For example, real estate acquired during the marriage may be designated as the individual property of each party, bank account funds will remain the separate property of each party, and property registered in one person’s name will remain the sole ownership of the registered party.

  3. English or Thai original language.

Please note that, A prenuptial agreement is considered invalid if it is not registered along with the marriage registration, or if it is not in writing and signed by both spouses and at least two witnesses, with the signed agreement attached to the marriage registration and recorded in the marriage register.
